What is Divorce Mediation?

In California, child support is calculated using a guideline formula established by state law. The formula takes into account several factors, including:

1. Income of Both Parents: The gross income of both parents is considered. This includes wages, salaries, bonuses, commissions, rental income, and other sources of income.
2. Time Spent with Each Parent: The amount of time the child spends with each parent (commonly referred to as "timeshare" or "visitation") is factored into the calculation. The more time a child spends with one parent, the lower the child support obligation for that parent may be.
3. Deductions and Adjustments: Certain deductions and adjustments may be made to the gross income of each parent, including payments for health insurance premiums, mandatory retirement contributions, and mortgage interest payments.
4. Childcare and Healthcare Costs: The cost of childcare and healthcare for the child may also be factored into the calculation.
5. Other Children: If either parent has children from another relationship whom they are legally obligated to support, this may affect the child support calculation.

Once these factors are considered, the court uses the guideline formula to determine the amount of child support that one parent will pay to the other. However, it's important to note that child support orders may be adjusted based on specific circumstances, such as the child's needs, special expenses, or other relevant factors.

For uncontested divorces where both spouses agree on all major issues, the process can be relatively quick. In California, there is a mandatory waiting period of six months from the date the respondent (the spouse served with divorce papers) is served with the divorce petition before the divorce can be finalized. This waiting period is mandated by California law and cannot be waived.

However, even in uncontested cases, it may take some time to complete the necessary paperwork, reach agreements on issues such as child custody and support, and obtain court approval. Once all paperwork is submitted and agreements are reached, the divorce can be finalized after the six-month waiting period has passed.
