Divorce mediation is a collaborative process in which a neutral third party, known as a mediator, facilitates communication and negotiation between divorcing spouses to reach agreements on various aspects of their divorce. Unlike litigation, where decisions are made by a judge, mediation empowers couples to actively participate in crafting solutions that meet their unique needs and interests.
During divorce mediation sessions, the mediator helps the couple explore and discuss important issues such as child custody and visitation schedules, division of assets and debts, spousal support (alimony), and any other relevant matters. The mediator facilitates constructive dialogue, encourages compromise, and assists the couple in generating creative solutions that are mutually acceptable.
One of the key advantages of divorce mediation is its focus on fostering cooperation and preserving relationships, particularly important when children are involved. By working together in a non-adversarial setting, couples can often achieve more amicable outcomes, reduce conflict, and minimize the emotional and financial costs associated with traditional litigation.
Once agreements are reached through mediation, they are typically documented in a legally binding agreement or settlement that can be submitted to the court for approval. While divorce mediation may not be suitable for every situation, it can offer divorcing couples a constructive alternative to contentious courtroom battles, promoting a smoother transition to post-divorce life for all parties involved.

In California, child support is calculated using a guideline formula established by state law. The formula takes into account several factors, including:
Once these factors are considered, the court uses the guideline formula to determine the amount of child support that one parent will pay to the other. However, it's important to note that child support orders may be adjusted based on specific circumstances, such as the child's needs, special expenses, or other relevant factors.
For uncontested divorces where both spouses agree on all major issues, the process can be relatively quick. In California, there is a mandatory waiting period of six months from the date the respondent (the spouse served with divorce papers) is served with the divorce petition before the divorce can be finalized. This waiting period is mandated by California law and cannot be waived.
However, even in uncontested cases, it may take some time to complete the necessary paperwork, reach agreements on issues such as child custody and support, and obtain court approval. Once all paperwork is submitted and agreements are reached, the divorce can be finalized after the six-month waiting period has passed.
